Terms of Service

1. Acceptance
By creating an account or using EriMarket, you agree to these Terms of Service. If you do not agree, do not use the platform.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract to use EriMarket. Sellers must be based in Europe and must complete payment provider onboarding to receive payouts.
3. Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must:
- Keep your password secure and not share it with anyone.
- Use your account solely for your own personal or business purposes.
- Notify us immediately at support@erimarket.shop if you suspect unauthorised access to your account.
EriMarket is not liable for any loss or damage arising from your failure to maintain the security of your account.
4. Order formation
Placing an order on EriMarket constitutes an offer to purchase. A binding contract is formed only when the seller confirms your order and payment is successfully processed. We reserve the right to cancel an order before confirmation — for example if a product becomes unavailable or a pricing error is identified — in which case you will receive a full refund.
5. Seller responsibilities
- Listings must be accurate, legal, and not misleading.
- Sellers are solely responsible for fulfilling orders and shipping products.
- Sellers must comply with all applicable export, import, and tax laws.
- EriMarket reserves the right to remove any listing that violates these terms.
6. Buyer responsibilities
- Buyers must provide accurate shipping information.
- Buyers agree to pay the listed price plus any applicable shipping costs.
- Disputes should first be raised with the seller; unresolved disputes may be escalated to EriMarket.
7. Fees and payments
EriMarket charges a platform commission on each completed sale. The exact commission rate is displayed during seller onboarding. All payments are processed by our third-party payment provider. EriMarket does not store payment card data.
8. Prohibited content
The following are not permitted on EriMarket:
- Counterfeit, stolen, or illegal goods
- Weapons, drugs, or hazardous materials
- Content that is fraudulent, hateful, or abusive
- Goods that infringe third-party intellectual property rights
9. Intellectual property
Sellers retain ownership of their product content. By listing on EriMarket, sellers grant us a non-exclusive licence to display their content on the platform for the purpose of facilitating sales. All EriMarket platform content, branding, and software remains the exclusive property of EriMarket and may not be reproduced without our prior written consent.
10. Right of withdrawal (EU consumers)
If you are a consumer in the European Union, you have the right to withdraw from a purchase within 14 calendar days of receiving your goods, without giving any reason (EU Consumer Rights Directive 2011/83/EU). To exercise this right, notify the seller via the EriMarket dispute system or contact us at support@erimarket.shop before the 14-day period expires.
Exceptions apply for perishable goods, custom-made items, sealed goods that are unsealed after delivery and are unsuitable for return on hygiene grounds, and digital content once download has begun with your consent. The right of withdrawal does not apply to business buyers.
Once you have notified us of your withdrawal, the seller must refund the price and standard shipping costs within 14 days of receiving the returned goods or proof of return. You bear the cost of returning the goods unless the seller agrees otherwise. The refund will be issued to your original payment method and may take up to 7 working days to appear depending on your bank.
11. Dispute resolution
If you have a dispute, please first contact the seller through the EriMarket dispute system. EriMarket will review open disputes and aims to respond within 7 working days. If you are an EU consumer and we cannot resolve your complaint, you may use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
12. Limitation of liability
EriMarket acts as an intermediary between buyers and sellers. We are not responsible for the quality, safety, legality, or delivery of listed items. Our liability is limited to the platform commission collected on a given transaction. We are not liable for indirect, incidental, or consequential damages.
13. Force majeure
EriMarket is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government action, internet outages, or third-party service failures. We will notify you as soon as reasonably practicable and resume performance when the circumstances permit.
14. Termination
We reserve the right to suspend or terminate any account that violates these terms, engages in fraudulent activity, or poses a risk to other users, without prior notice. You may delete your account at any time from your account settings or by contacting us.
15. Changes to these terms
We may update these terms from time to time. For material changes, we will provide at least 14 days' notice by email or by a prominent notice on the platform before the changes take effect. Your continued use of EriMarket after that date constitutes acceptance of the updated terms. If you do not accept the changes, you may close your account before the effective date.
16. VAT and taxes
EriMarket is an online marketplace facilitating sales between independent sellers and buyers. VAT obligations depend on the seller's country of establishment and the buyer's location.
- Sellers are responsible for complying with VAT regulations in their country of establishment.
- EU sellers whose cross-border EU sales exceed €10,000 per year must register for VAT OSS (One Stop Shop).
- B2B buyers with a valid EU VAT number may be eligible for VAT reverse charge — enter your VAT number at checkout.
- Applicable VAT is calculated and collected at the time of payment.
17. Governing law
These Terms of Service are governed by and construed in accordance with EU law and the laws of the country in which EriMarket's operator is established. Any disputes that cannot be resolved through our dispute resolution process will be subject to the exclusive jurisdiction of the courts of that country, without prejudice to your rights as an EU consumer to bring proceedings in your country of residence.
